There was a motion to accept the minutes of the April 23rd meeting.  The motion was seconded and accepted with a vote of 4-0-0.

Discussion:  31 Anthony Road
Mr. & Mrs. Keith Dewar, homeowners of 31 Anthony Road, both appeared before the Commission requesting permission to reseed a new lawn.  The backyard borders the wetlands and requested direction from the Commission as to how to proceed with this work.

Mr. Dewar stated that the wetlands are approximately 50 ft. from the rear of the house.  The front yard would not be located within the buffer zone.  The area would be predisturbed area.  

The Commission members stated that they do not want to see the area of the lawn expanded from what is existing.  They requested haybales or silt socks to be placed at the downgradient to the wetlands and the work should be performed in the Fall.  The use of organic fertilizers were suggested by the Commission members.

The Commission requested that the applicant file a Request for Determination for this proposed work.


Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.

The Commission stated that they are requiring Mr. Ron Clough, Supervisor of the State Forest on Grove Street, to file a Request for Determination of Applicability for his proposed work on the SNETT Trail.  The work will encompass the use of a small machine to smooth out the moguls on the trail.  

Paul Boncek informed the Commission that he will not be seeking another term on the Conservation Commission but he is interested in becoming an Associate Member.

There was a motion to ratify the nomination of Monique Allen as a Conservation Commissioner.  The motion was seconded and accepted with a vote of 4-0-0.


Public Hearing – Notice of Intent – 53 Dover Circle – Patel - CE159-982
Mr. Donald Nielsen, Engineer of Guerriere & Halnon, appeared before the Commission for the grading of a low point at the rear of the house at 53 Dover Circle.  Mr. Nielsen stated that there is a depression in the backyard which was left remaining after the construction of the detention pond when the house was built in the 1980’s.  This depression has become overgrown with shrubs.

The homeowner is attempting to sell the house and the potential buyers would like permission to have this depressed area filled to have a flat area for lawn or possible play area.  There would be approximately 800 sq. ft. of level area draining into the detention area not the wetland area.  There will be approximately 15-20 yds. of material being brought in to fill this area.

A Commission member made note of the fact that the area is previously disturbed area and there is no building taking place.

Another Commission member stated that the Natural Heritage reported that this is not an estimated habitat.  There had previously been found a 4-toed salamander on the adjacent lot but an individual specimen does not constitute a habitat.

The Commission members scheduled a site walk of the property on Tuesday, May 26th at 6:30 p.m.

The Chairman noted that there was no one in the audience for this public hearing.

Mr. Alfieri informed the applicant of 3 items to be addressed in this Notice of Intent filing.

There was a motion to continue the hearing until June 4th so that the Commission may conduct a site walk.  The motion was seconded and accepted with a vote of 4-0-0.





Continued - Notice of Intent – Lot 1, 1084 Pond Street – Schultz – CE159-976
The Commission Chairman opened the public hearing and stated that a letter dated May 21, 2009 has been received from the applicant’s representative requesting the public hearing be continued until the next Conservation meeting on June 4, 2009.  

There was a motion to continue the hearing until June 4, 2009.  The motion was seconded and accepted with a vote of 4-0-0.


Continued - Public Hearing – Notice of Intent – Lot 2, 1086 Pond Street – Schultz – CE159-977
The Commission Chairman opened the public hearing and stated that a letter dated May 21, 2009 has been received from the applicant’s representative requesting the public hearing be continued until the next Conservation meeting on June 4, 2009.  

There was a motion to continue the hearing until June 4, 2009.  The motion was seconded and accepted with a vote of 4-0-0.


GENERAL BUSINESS

Minor Buffer Zone Activity:  880 West Central Street
The applicant has requested to clean up some debris, plant some white birch trees and trim some branches on his property.  This proposed work would take place in the Fall.

There was a motion to issue a Negative Determination subject to 3 Special Conditions.  The motion was seconded and accepted with a vote of 4-0-0.

Certificate of Compliance:  13 Bubbling Brook Drive – CE159-960
Mr. Alfieri informed the Commission that this site was permitted at the beginning of 2008 for a septic system.  The monuments that were erected at the conclusion of the installation of the septic system have been lowered according to the Commission’s recommendation.

There was a motion to issue a Certificate of Compliance for 13 Bubbling Brook Drive.  The motion was seconded and accepted with a vote of 4-0-0.
